Inheriting a house in Illinois involves navigating the probate process, which is necessary to legally transfer ownership of the property to the heirs. Step Three: the executor must notify creditors and heirs. All creditors must be notified of the person’s passing; this allows them to file a claim against the estate. At the same time, the executor must also inform all heirs or beneficiaries if they are named in the will.
Step Four: Pay all necessary debts. The estate must first pay all taxes and debts owed before distributing assets.
Step Five: Distribute assets. Once all the debts are paid, the executor can finally distribute the assets according to the will or intestacy laws if there is no will. It is at this point that you will finally inherit the house.
Step Six: Close the estate. When all bills are paid, all accounts closed, and all assets distributed, the executor can legally close the estate.
